I, the undersigned participant (or parent/legal guardian if the participant is a minor), voluntarily choose to participate in a fishing charter or related water activity operated by Always Somethin' Charters / Always Somethin' Outfitters, its owners, captains, employees, agents, and affiliates (collectively, the "Company").

1. Assumption of Risk

I understand that fishing from a boat and related water activities involve inherent risks, including but not limited to:

• Capsize, falling overboard, drowning, or injury from waves, weather, or sea conditions

• Injury from fishing equipment (hooks, lines, rods, gaffs, etc.)

• Slippery decks, boat motion, or collisions

• Marine life encounters, sun exposure, dehydration, or motion sickness

• Equipment failure or actions of other participants

I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Company, to the fullest extent permitted by law.

2. Release and Waiver of Liability

In consideration of being allowed to participate, I hereby release, waive, discharge, and hold harmless the Company, its owners, captains (including but not limited to Capt. Srbo Trikich and other assigned captains), employees, agents, and vessels from any and all claims, demands, damages, or causes of action arising out of or related to my participation, including claims for personal injury, death, or property damage, whether caused by negligence or otherwise, to the maximum extent allowed by Florida and applicable maritime law.

I agree to indemnify and hold the Company harmless from any claims brought by or on behalf of me or my minor child arising from participation in the charter.

3. Fitness & Medical Acknowledgment

I certify that I (and any minor participant) am physically and mentally fit to participate, have no medical conditions that would make participation unsafe, and will inform the captain of any relevant medical issues or medications. I authorize emergency medical treatment if needed and accept responsibility for related costs.

4. Photo, Video, and Likeness Release (Disclosure & Consent)

I understand that the Company may take photographs, videos, or other recordings during the charter for safety, documentation, or promotional purposes.

I grant the Company a perpetual, royalty-free, worldwide right to use, reproduce, edit, publish, and distribute any photos, videos, or recordings that include my (or my minor child's) image, likeness, voice, or name for marketing, advertising, social media (including Facebook, Instagram, website, and other platforms), promotional materials, and related business purposes, without additional compensation or further consent.

I waive any right to inspect or approve the finished product and any claims related to such use (including privacy, publicity, or defamation claims).

5. Rules & Compliance

I agree to follow all captain instructions, safety rules, and applicable laws. Failure to do so may result in termination of the charter without refund.

6. Governing Law & Severability

This agreement is governed by the laws of the State of Florida and applicable U.S. maritime law. If any provision is found unenforceable, the remaining provisions remain in full effect. This document constitutes the entire agreement on these subjects.
